General terms and conditions of sale

ARTICLE 1 - SCOPE OF APPLICATION

These general terms and conditions of online sale (hereinafter "GTC") are entered into between:

On the one hand, the company MAISON DAUCOURT, Limited Liability Company, with a capital of 39,331.45 Euros, registered with the RCS of Angoulême (16) under SIRET number 40915511600034 having its registered office at 24 rue des Bosquets, 16000 Angoulême.

On the other hand, any consumer making an online purchase on the Maison DAUCOURT website, namely www.daucourt.com (hereinafter the "CUSTOMER").

These Terms and Conditions apply exclusively to individual consumers acting in a non-commercial capacity to satisfy their personal needs. As such, the CLIENT declares that they have the legal capacity to enter into this contract, are of legal age, and are not subject to any protective measures.

All orders placed by the CLIENT on the Maison DAUCOURT website www.daucourt.com imply prior, express and unreserved acceptance of the CGV by the latter, to the exclusion of any other document in contradiction with these CGV.

The Terms and Conditions may be modified at any time by MAISON DAUCOURT. The Terms and Conditions applicable to all orders placed on the Website will be those in effect on the date of the order.

The headings of the articles in the General Terms and Conditions are provided for guidance purposes only. They will be deemed null and void in the event of any problem in the interpretation of the headings or clauses of the General Terms and Conditions.

If any provision of these General Terms and Conditions is deemed invalid by a court of competent jurisdiction, it will be expressly severed. However, this severance will not affect the validity of the remaining provisions of these General Terms and Conditions.

The fact that MAISON DAUCOURT does not invoke any of the CGV at any given time cannot be interpreted as a waiver of the right to invoke any of said conditions at a later date.

ARTICLE 2 - OFFER

2.1 In accordance with Article L. 111-1 of the Consumer Code, the products for sale on the Website and their essential characteristics are presented by the company MAISON DAUCOURT in the form of technical data sheets.

2.2 For any questions relating to the products offered on the site, the CUSTOMER can contact customer service in accordance with article 9 of the General Terms and Conditions.

ARTICLE 3 - ORDER

3.1 The CUSTOMER has the option to place their order:

- Directly on the website exclusively.

- MAISON DAUCOURT does not accept or take any orders by telephone.

3.2 When placing their first order via the Website, the CUSTOMER must provide their email address in order to create a customer account. The CUSTOMER will then need to complete an electronic form. This information is essential for processing and shipping orders and issuing invoices.

Orders can be placed and recorded on the Website, if the CUSTOMER has identified themselves by entering their email address and password.

Inadequate or insufficient information provided by the CLIENT prevents final validation of the order.

3.3 Any order placed constitutes acceptance of the prices and descriptions of the products.

An order will only be considered final upon full and effective payment of the sums due.

A written order confirmation will be sent to the CLIENT by email with an order number.

The order confirmation and all data recorded by MAISON DAUCOURT constitute proof of transactions. MAISON DAUCOURT reserves the right to cancel any order from a customer with whom it has had a dispute concerning payment for a previous order, or any order presenting abnormal conditions and/or not complying with the General Terms and Conditions of Sale.

MAISON DAUCOURT also reserves the right to request proof of identity and/or proof of address for any order placed on the Website. This information will always remain confidential within MAISON DAUCOURT.

3.4 Out-of-stock items or items awaiting restocking are indicated on the product page on the Website. The CUSTOMER will not be able to select the product in question and add it to their order.

In the event of a temporary and exceptional stock shortage not indicated on a product, MAISON DAUCOURT undertakes to notify the CLIENT by email or telephone and to reimburse them if necessary.

If the CLIENT does not respond, the order validated on the Website by the CLIENT containing one or more out-of-stock products will be put on hold in its entirety until the products are received by the company DAUCOURT.

In the event that the CLIENT wishes to receive a refund for the out-of-stock product, MAISON DAUCOURT will proceed with the refund within fifteen (15) days in accordance with the conditions established in the General Terms and Conditions.

ARTICLE 4 - PRICE

4.1 The price of each product indicated on the Website is expressed in Euros including all taxes.

All prices shown in Euros on the website are valid only in the countries selectable on the website.

Prices do not include shipping costs, which are calculated automatically when the order is finalized based on its weight and destination.

4.2 The invoice corresponding to the CLIENT's order is available on the Website in their customer area via their order details.

4.3 The invoice will be issued with French VAT.

All prices are subject to correction in case of obvious typographical errors. Should an obvious typographical error occur in pricing, MAISON DAUCOURT will inform the CLIENT that the order will be invoiced at the corrected price.

The CLIENT will have the option to accept the order under the corrected conditions or to cancel the order.

4.4 MAISON DAUCOURT reserves the right to modify the prices displayed on the Website. Prices shown online are subject to change at any time without notice.

However, price changes cannot be applied to orders already confirmed by a customer. The prices in effect at the time the customer confirms the order will apply.

ARTICLE 5 - PAYMENT TERMS

All purchases on the Site are payable in full and in cash at the time of ordering.

Any bank charges levied by the CLIENT's bank remain the CLIENT's responsibility.

The CLIENT will credit the MAISON DAUCOURT account with the sum corresponding to the total amount to be paid, specifying the name and order number.

An order is shipped only after full payment has been received. The goods remain the property of MAISON DAUCOURT until full and final payment is received. This retention of title does not preclude the transfer of risk, which remains with MAISON DAUCOURT until the CLIENT takes physical possession of the goods, or until a third party designated by the CLIENT, other than the carrier, takes possession.

ARTICLE 6 - DELIVERY OF PRODUCTS

6.1 DAUCOURT undertakes to ship parcels by dropping them off at a Pickup point within 96 hours (business days) of receiving payment. The standard shipping method is handled by CHRONOPOST services.

The CUSTOMER's parcel is delivered by postal services directly to the Pickup point indicated by the CUSTOMER when placing their order (List of available points on www.chronopost.fr)

The recipient's digitized signature, as well as its reproduction, or any other indisputable means of secure identification, constitutes proof of delivery of the packages and the parties recognize that this signature has the same legal value as a traditional signature on paper.

Items delivered to a Pickup Point are handed over to the recipient or their representative upon presentation of identification. The holding period is 7 calendar days from the date of arrival at the Pickup Point.

Upon delivery, any damage or loss of contents must be noted by the recipient in writing, with precise, complete, dated and signed reservations on the delivery slip.

Shipping costs are free for all orders placed in mainland France and Europe with the exception of Corsica, hard-to-reach areas (list of hard-to-reach areas available on www.chronopost.fr), remote international areas (list of remote international areas available on www.chronopost.fr), DOM TOM and overseas territories, for which specific shipping costs are applied.

ARTICLE 7 - RIGHT OF WITHDRAWAL

7.1 In accordance with Article L121-21 of the Consumer Code, the CLIENT has fourteen (14) clear working days from the delivery of his order to exercise his right of withdrawal with DAUCOURT.

If this deadline expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

A standard withdrawal form is available as an appendix to these General Terms and Conditions of Sale.

7.2 For any refund or exchange of a product, the CUSTOMER must return the product within this period to the company MAISON DAUCOURT.

The product must be returned in perfect condition, in its original packaging, to the following address: Maison DAUCOURT – 24, rue des Bosquets – 16000 ANGOULÊME.

Any damaged, opened, or otherwise used product will be refused. Any product in a condition unsuitable for resale will not be eligible for a refund.

MAISON DAUCOURT cannot be held responsible for the loss or damage of returned packages.

The costs associated with reshipping the product are the responsibility of the CUSTOMER.

When returning the product, the CUSTOMER must include the invoice. DAUCOURT will exchange or refund the product at its purchase price, including delivery charges, within 14 (fourteen) calendar days of receiving the returned product.

ARTICLE 8 - GUARANTEES AND LIABILITY

8.1 In accordance with legal provisions, the products offered by the company DAUCOURT on the Website www.daucourt.com benefit from the legal guarantees provided for in Articles 1641 and 1648 of the Civil Code, and L.211-1 to L.211-18 of the Consumer Code.

MAISON DAUCOURT shall not be liable for damages of any kind resulting from misuse, negligence, lack of maintenance or deterioration of the product due in particular to abnormal storage or preservation conditions by the CLIENT.

8.2 MAISON DAUCOURT cannot be held liable in the event of force majeure.

Force majeure is understood to mean any event such as those usually recognized by French case law.

8.3 The products offered on the website www.daucourt.com are not intended for use by professionals.

Consequently, MAISON DAUCOURT cannot be held liable for any damage whatsoever resulting from the use of the purchased product for a professional activity.

8.4 MAISON DAUCOURT declines all responsibility for any technical difficulties that CLIENTS may encounter on the Website, whatever their cause or origin, including in the event of bugs, failure to maintain the integrity of information through communication networks, failure of the terminal to render information or failure to transmit and deliver their orders within normal timeframes.

8.5 The products sold on the website www.daucourt.com comply with the regulations in force in France. MAISON DAUCOURT cannot be held liable for any violation of the regulations of any other country where the products are delivered.

8.6 The hyperlinks present on the www.daucourt.com website lead to other websites.

The company MAISON DAUCOURT does not exercise any rights over these.

Therefore, MAISON DAUCOURT cannot be held responsible for any reason whatsoever for any content, products and/or services or any data or information available on or from external sites and/or sources, which would violate French, Community or international regulations.

DAUCOURT cannot be held responsible for the non-conformity of products sold by its partners and/or any other problem of this nature.

Third-party sites or partners of DAUCOURT may use hyperlinks referring to the Site, subject to prior written acceptance by the company MAISON DAUCOURT.

Customers and all users of the Maison DAUCOURT website acknowledge that MAISON DAUCOURT cannot be held responsible for these links and for the content of third-party sites producing such a link to MAISON DAUCOURT.

ARTICLE 9 - CUSTOMER SERVICE

Customer Service is available to the CUSTOMER for any questions or information relating to our services, products or the tracking of your order.

ARTICLE 10 - PROTECTION OF PERSONAL DATA - CONFIDENTIALITY

10.1 In order to comply with European and French standards for the protection of personal data and privacy, the company DAUCOURT is registered with the National Commission for Information Technology and Freedoms (CNIL)

The personal information provided by the CLIENT during registration is recorded and stored securely.

10.2 The CLIENT has a right of access, rectification and objection to personal data concerning him/her, in accordance with the French Data Protection Act no. 78-17 of 6 January 1978.

In the event that the CLIENT wishes to modify, add, delete personal data (inaccurate, outdated, etc.) recorded by the company MAISON DAUCOURT, the CLIENT must send a letter to the said company, accompanied by a photocopy of his identity card to the following address: Maison DAUCOURT – 24, rue des Bosquets – 16000 ANGOULÊME.

The company MAISON DAUCOURT is committed to respecting the strict confidentiality of personal information provided by the CLIENT.

ARTICLE 11 - SITE PROTECTION

The Website is the exclusive property of the company MAISON DAUCOURT.

Therefore, the content of said Site (texts, photographs, graphic charter …) constitutes works within the meaning of articles L112-1 et seq. of the Intellectual Property Code.

Therefore, any reproduction, in whole or in part, of the Website and/or any of its elements is strictly prohibited without the consent of the rights holders of MAISON DAUCOURT. Any use of the Website's elements must be subject to the prior written authorization of MAISON DAUCOURT.

Any use, representation or reproduction of the trademark and/or logo is strictly prohibited, under penalty of prosecution, particularly for counterfeiting.

If a person wishes to use the Site's information for commercial or other purposes, they must inform MAISON DAUCOURT (via customer service) in advance and in writing, which reserves the right to accept or refuse the request.

ARTICLE 12 - APPLICABLE LAW

The terms and conditions are governed by French law.

In the absence of an amicable settlement, any person not complying with these stipulations shall be held accountable before the competent French courts.
